Terms of Service for Build a Link

A new era of link building is here. These updated Terms of Service for Build a Link, operated by MDUS LLC in the United States and Millenio Ltd in the European Union, are designed to be clear, fair, and transparent. We’ve cut through the legal jargon to provide a straightforward guide to our collaboration.

This document governs the partnership between you, our valued client (“Client” or “you”), and the Build a Link entity corresponding to your geographical location (“Build a Link,” “we,” or “us”). For Clients based in the Americas, your agreement is with MDUS LLC, a limited liability company based in the United States. For Clients in the European Union and the rest of the world, your agreement is with Millenio Ltd, a private limited company registered in the United Kingdom.

Your engagement with our services, initiated through our online platform or with a Build a Link representative, signifies your acceptance of these terms, effective from the date of your order. This document, alongside your specific order details, forms the complete agreement for our partnership.

Our Commitment: Forging High-Caliber Links

Build a Link provides a dynamic marketplace for bespoke link-building services. Our primary mission is to facilitate the creation and placement of high-quality content and backlinks to enhance your online presence. These terms apply to all services procured from Build a Link.

To deliver our specialized services, we may engage a network of trusted subcontractors and third-party publishers. Rest assured, the quality and integrity of the work remain our responsibility.

Should you require services beyond our standard offerings, we are happy to discuss and define the scope and pricing for these “A La Carte” services in a separate written agreement. These core terms will continue to apply unless otherwise specified.

Fair Pricing and Seamless Payments

The investment for our services is detailed in your order. All prices are exclusive of any applicable Value Added Tax (VAT) or sales tax. We reserve the right to adjust our pricing, and any changes will be reflected on our platform.

For your convenience, invoices are to be settled within eight (8) days of receipt. In the event of a delay in payment, we will apply default interest in accordance with the prevailing laws of the relevant jurisdiction (Danish Interest Act for Millenio Ltd and applicable state law for MDUS LLC).

In the rare instance that a service cannot be fulfilled due to third-party actions (e.g., a publisher withdrawal), you will receive a credit to your Build a Link account. We will promptly inform you of any such non-completion and the corresponding credit.

Your Role and Responsibilities

Our success is a collaborative effort. You acknowledge that the effectiveness of our services hinges on the accuracy and completeness of the information you provide. The responsibility for the validity of this information rests with you.

While we are confident in our ability to enhance your online footprint, we do not guarantee specific outcomes such as increased revenue, traffic, or search engine rankings.

Mutual Respect and Brand Integrity

We honor the intellectual property of your brand. While we will use your name and trademarks for marketing purposes to showcase our successful partnerships, your brand identity remains your exclusive property.

You agree to indemnify and hold harmless Build a Link, its affiliates, and its team from any claims or damages arising from the information you provide for our services or any willful misconduct on your part. This includes any disputes related to marketing practices.

Liability and Disclaimers: A Clear Framework

Our liability for any damages will be governed by the general principles of law in our respective jurisdictions, subject to the limitations outlined below.

The Build a Link marketplace is a tool for building your brand, not a lead generation list for your own commercial use. Any attempt to misuse our platform in this manner will result in an immediate and permanent ban, and you will be liable for any demonstrable loss of revenue to Build a Link.

We are not liable for any indirect losses, including but not limited to, loss of profit, time, or data. We disclaim any product liability and any liability for the validity of the information you provide. Our total liability in any matter will be limited to the total value of your order.

Confidentiality: A Pillar of Our Partnership

We pledge to maintain the confidentiality of all proprietary information shared during our engagement. This includes the details of your orders and any non-public information on our platform. This commitment to confidentiality extends for a period of five years following the conclusion of our work together. We may disclose confidential information only when required by law or with your prior written consent.

Unforeseen Circumstances

Neither party shall be held liable for any failure to perform its obligations due to events beyond our reasonable control, including but not limited to, natural disasters, acts of war, terrorism, internet failures, or cyber-attacks (“Force Majeure Event”). The party affected by such an event will promptly notify the other and take reasonable steps to mitigate the impact.

Data Utilization for Enhanced Service

To ensure our content aligns seamlessly with your brand’s tone and voice, you grant us permission to crawl and scrape your website(s). The data collected will be used to enhance the content we create for your campaigns and for the general improvement of our services. All data will be managed in strict accordance with our Privacy Policy and applicable data protection laws.

Governing Law and Jurisdiction

For Clients contracting with MDUS LLC, this Agreement and any disputes arising from it shall be governed by and construed in accordance with the laws of the State of Delaware, USA, and subject to the exclusive jurisdiction of the courts of Delaware.

For Clients contracting with Millenio Ltd, this Agreement and any disputes arising from it shall be governed by and construed in accordance with the laws of England and Wales, and subject to the exclusive jurisdiction of the courts of England and Wales.
